Terms of Service

Welcome to BARTR ("BARTR," "we," "our," or "us"). By accessing or using the BARTR mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be legally capable of entering into binding agreements in your jurisdiction. By using the App, you represent that you meet this requirement and will comply with all applicable laws.

2. Nature of the Platform

BARTR is a technology platform that enables users to connect and arrange service-for-service exchanges.

  • BARTR does not employ users.
  • BARTR is not a party to user-to-user agreements.
  • BARTR does not guarantee the quality, legality, safety, or completion of any exchange.

Users are solely responsible for the agreements they enter into.

3. Exchanges & Start Exchange Feature

Users may negotiate exchanges freely.

When users initiate an exchange using the Start Exchange feature:

  • The agreed exchange terms are recorded in-app.
  • A default system may apply if one party fails to complete their agreed service.
  • Applicable fees are disclosed prior to confirmation.

Independent cash arrangements outside the App are made entirely at users’ own risk and are not governed by BARTR’s in-app exchange system.

4. Platform Fees

BARTR may charge fees for certain features. All fees are disclosed before payment and are non-refundable unless required by law.

4.1 Service Fee

A default service fee (currently 5%) may apply to exchanges initiated through the Start Exchange feature. The amount is shown before confirmation.

5. Optional Protection Program

Users may elect to participate in the BARTR Protection Program for an additional fee disclosed at checkout.

  • The program is optional.
  • It may replace the default service fee where indicated.
  • It provides a contractual payment guarantee if a counterparty fails to fulfill a Start Exchange agreement.
  • It applies only to exchanges formally initiated within the App.
  • Coverage is limited to the exchange value recorded in-app.
  • Claims are subject to review and verification.
  • This program is not insurance, a banking service, escrow service, or financial product.

The Protection fee:

  • Is non-refundable.
  • Is earned upon purchase.
  • Is retained by BARTR regardless of exchange outcome.

BARTR reserves sole discretion in determining eligibility for claims and whether a default occurred.

6. Verification Services

BARTR may offer optional paid verification services, including:

  • Identity verification
  • Educational credential verification
  • Professional certification verification

Verification fees:

  • Are one-time payments.
  • Are non-refundable.
  • Cover administrative review and processing only.
  • Do not constitute endorsement or guarantee of services.

Verification status may be revoked if information is later determined to be inaccurate or misleading.

7. Payment Processing

All payments are processed by third-party providers such as Stripe. By making a payment, you agree to the payment processor’s terms and acknowledge that transactions may be subject to holds, reversals, disputes, or chargebacks. BARTR is not responsible for actions taken by payment processors.

8. Prohibited Activities

  • No harassment, fraud, scams, or illegal activity.
  • No provision of regulated professional services without proper licensing.
  • No attempts to hack, disrupt, or reverse engineer the App.
  • No posting unlawful or harmful content.

9. Disputes Between Users

BARTR may review disputes related to Start Exchange agreements at its discretion but is not required to intervene. Decisions regarding Protection Program claims are final.

10. Limitation of Liability

To the maximum extent permitted by law:

  • BARTR is not liable for user conduct or exchange outcomes.
  • BARTR makes no guarantees regarding successful exchanges.
  • BARTR’s total liability shall not exceed the total fees paid by the user to BARTR in the preceding twelve (12) months.

11. Termination

We may suspend or terminate accounts for violation of these Terms or conduct that harms the platform or its users.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware.
